After the oral argument, I said SCOTUS was going to have to set back sex discrimination jurisprudence by decades. I hoped the religious analogy we put in our amicus brief (which Sotomayor used in her dissent) might make a few of the conservatives hesitant to revive the “burdens equally” approach.

Sorry if I misunderstood. What Canada does is consistent with the UN Convention on Refugees. MAGA here is using the “port of entry” language to unwrite nearly a century of law and practice permitting anyone who reaches US soil to claim asylum.

Yes. They were blocking people from applying for asylum at the ports of entry at the Mexican/U.S. border. And then they argued that people who crossed the border and turned themselves in were not valid asylum seekers because they did not go through a port of entry.

Equally problematic, most agencies have support staff departments -- IT, Human Resources, legal counsel, janitors, security, etc. -- that are necessary for them to function, but are not "created" by any statute.

Only some departments within federal agencies are specifically created by statute. Congress might vest an agency with responsibility to do certain tasks but then the agency might create a department dedicated to the task. Under DOGE reasoning, that prioritizes those employees for RIF /1

Actually, many undocumented workers use false SSNs to get past the employer verification, they pay into SS through withholding, but cannot collect. That money is critical to funding SS.
