And as for DOJ availability - in ordinary times, yes, courts might have accepted shutdowns as an excuse for limited staffing in non- urgent matters. I'm skeptical the courts would tolerate it for, e.g., the government attempting to sneak hundreds of children out of the country at 2 am on a weekend.

Courts can remain open for several weeks in the event of a shutdown. While the Trump admin might attempt to hamper the courts by shutting down the courthouses themselves, I don't think the courts would allow that to stop their work entirely - especially with the ability to hold virtual hearings.

How significant is the distinction between Congressional testimony under oath vs not under oath? Even if a witness is not under oath, wouldn't a deliberate false statement in their testimony still be a criminal violation of the False Statements Act, 18 USC 1001?

Giving the head of the employee union a very personal axe to grind, as well as an unlimited amount of free time to work on his union duties, seems... as short- sighted and poorly thought out as most of this admin's actions. May he make the best of their error to fight for his former colleagues.
