I am sensitive to the need to train lawyers and realize that sometimes such a division gives somebody an opportunity that might not otherwise exist. That said, from my perspective the division of labor is not usually as obvious to me as it is to the lawyers.

And third, focusing on the historical sources necessarily focuses the interpreter's mind only on originalist-style interpretation. In contrast, I support a pluralistic approach to constitutional interpretation, using all available interpretive tools to derive the best possible interpretation.

Second, the design of the project limits the visibility of external sources. In my state and others, much of the action was in the choices of what to borrow and what to change from prior constitutions adopted by sister states. That important stuff gets missed.

First, state constitutional records are often lousy. In my home state of Maryland, we don't really have convention records for the constitutional convention that adopted our current constitution. Instead, we have contemporaneous press accounts from partisan newspapers.

My article is a response to a lecture given by Dr. Nicholas Cole (@quilldir.bsky.social) at the Third Annual Robert F. Williams Lecture on State Constitutional Law. Dr. Cole's speech explained his project of digitizing state constitutional convention records.
