What did you see, Admiral Bradley, that indicated to you that they were continuing their previous activities? What specific actions did they take to show that they weren’t hors de combat and they needed to be eliminated in order for you to safely finish your mission? Simple question.

Regarding William Calley, the only reason he wasn’t charged with war crimes specifically was due to the definition of a protected person in the 4th Geneva Convention didn’t include “allied civilians”. I’m not really sure what that means. I can guess but your guess would be as good as mine.

A murder charge is also something he doesn’t really have a legitimate defence for. There are arguments he could make but I don’t know how much weight they would hold. He would also probably have to be tried in a military court which is a whole other issue.

So to sum up. Nope. Doesn’t have to be a declared war. But (and it’s a big but) as the US is not a party to the International Criminal Court, any prosecution would have to be domestic in a US court. Or he could be just charged with murder which is probably more likely.

There’s probably an argument that they could have made that there’s no armed conflict between the US and Venezuela itself. Except they claimed that the drug boats are being sent on behalf of the Venezuelan government so they basically screwed themselves with that argument. Which is just delightful

It does appear that the US does have a war crimes statute that basically mirrors the Geneva Conventions and there just has to be armed conflict between two nations for the Conventions to apply. (There’s other elements involved but they’re not really an issue).

Ok. As an example we weren’t technically* at war with Vietnam, but William Calley was still charged with murder for the My Lai massacre.

*Meaning there was no specific declaration of war. Obviously we were in every other way, at war with the North Vietnamese.

If its released, the people that have seen it would be legally allowed to comment on the files. Whereas before, there were/are Attorney-Client/National Security issues that bar them from speaking about it.
