HUGE lesson here for the response of legal system if (when) Dems regain power — there cannot again be a reluctance to pursue consequences for unlawful conduct out of concerns for comity or appearing too partisan

Apples to oranges in many respects, but still does not seem too much of a stretch to aspire to the efficiency of the trains in the some random airport (except Newark)

You are talking about Bill Belichick and Bob Kraft, right?

Still amazing to me how many attorneys continue to work in the Department... Nobody is indispensable, but honor and the oath to the Constitution is forever

This illustrates the most amazing thing abut the Unitary Executive Theory endorsed by Supreme Court: the unitary nature of executive expands and contracts as necessary to fit the needs of current President

I.e. POTUS has unlimited power to order DOJ to release documents, unless he doesn't want to

Alex, you underestimate the sheer joy in being able to take a nap at halftime knowing that the game will lack all drama

100%

Back in my day, we used an old cassette tape recorder as a back-up, too, for Grand Jury

(It was the early 2000s, not ancient history, but at least we had recording technology)

Missing grand jury tapes/transcript could, perhaps, by itself lead to conclusion of misconduct; judges commonly instruct juries that if the government intentionally failed to preserve evidence, they may infer that this evidence was unfavorable to the government (see e.g. 9th Cir Model Instr 4.19)

Everyone wants to see Texas and A&M in the same bracket, right? The anxiety level for Aggies will be through the roof.

I can translate the subtle message being sent here for non-lawyers:

"Obviously, our public line will be that we are considering the Order, but it doesn’t matter what you Order... We will send men to kill your pets and fuck your wives, and it will never be over. So, that’s the message.”

“I have never tried that before, so I think I should definitely be able to do that.”

Democratic willingness to “punish” enemies in the same way we are now seeing is, paradoxically, the only thing that would permit meaningful reform

Only if Republicans fear their ox could also be gored in a Democratic administration will they be willing to act so nobody’s ox is gored going forward

Considering that the Auburn AD is quoted describing Freeze as "a man of integrity," really hard to see how the next hiring is likely to be reality-based enough to be successful
November 2, 2025 at 11:18 PM
Just as heartbreaking to see good lawyers convince themselves to stay for “reasons” and either directly aid in the weaponization or merely give a patina of legitimacy to what is happening at DOJ

The whole thing is a Shonda

Aside from race, one of the things I observed in working on redistricting issues in Ohio is some Dems *preferred* partisan gerrymanders, even when it meant that they would be a permanent majority, because it created and preserved safe democratic seats that representatives could hold forever

It’s also a lot easier to catch when people use text messaging as part of their criminal conspiracies — the lack of tradecraft these days is astonishing

"We have top men working on it right now."

"Who?"

"Top... men."

Can we include the contract extension for Charlie “decided schematic advantage" Weiss at ND as part of the argument for Belichick being the worst?
October 8, 2025 at 11:49 PM
Gotta disagree with suggestion he “was and is a good coach”

Context does matter,, and evidence in context suggests Belichick is just a replacement level coach who successfully leveraged a combination of lucking into a generational quarterback and cheating into an undeserved “genius” label

The word “flirty” is doing a lot of work in that sentence

Do paid ads really represent the preference of progressive donors?

The more likely explanation for what is described is that consultants who run PACs make commission money from paid ads, so steer donations in that direction
