The use of the hypothetical is weird. Like on the one hand it sounds like something that could definitely happen, but it's also so rare that they had to make up a test case?

I've been unable to find a single article about the Friesen decision, which I suspect is because it came out one month into COVID.

But this is what it says, and I have watched appeals in which it's led to child sex offenders getting longer sentences.
