What a week…from SEALS to the National Organization of Bar Counsel…to a cancelled flight back to Maine. Somehow I’m back in Oklahoma City, and I just might collapse.

My summer writing really kicks into gear next week after I fly back to Maine. Tonight I created my article writing tracker for “As Yet to Be Titled Trademark and Legal Ethics Article,” which automatically color codes my daily and total progress relative to estimated targets. Let’s go!

I'm excited to be publishing "An Unreliable Reporter" with the Georgetown Law Journal Online! In it, I discuss how govt lawyers may be pressured to violate their ethical obligations by pursuing unwarranted sanctions against adversaries. Feedback welcome! SSRN:

Things are still firming up, but I'm happy to share my latest ethics article, "An Unreliable Reporter," which teases out the way that federal government attorneys are being put in untenable positions. It'll be up on SSRN soon, but I have a teaser below.

Big thanks to Professor Dan Walters (@profdanwalters.bsky.social) (Texas A&M), who presented his latest administrative law project at the University of Oklahoma College of Law (@uofoklahomalaw.bsky.social) today. I can't wait to see the article in print!

On Monday, @uofoklahomalaw.bsky.social hosted Prof. Patrick Perkins as part of our junior faculty exchange with the Univ. of Kansas School of Law. He presented his latest project, "People are Corporations, Too." It was a lively discussion!

I'm so excited to have Prof. Jessica Tueller join Oklahoma Law this fall as one of several new hires. I have been watching her grow as a teacher and scholar over the past several years (currently a Forrester Fellow at Tulane)--and the sky is the limit.

We were lucky to have Prof. Sue Provenzano from Georgia State College of Law come to OU Law to kick off our Spring 2025 Faculty Speaker Series. She presented her spectacular work-in-progress, "The Deceptive New Legal Fiction of General Jurisdiction." Next Up: Prof. Brandon Johnson from Nebraska!

I had a blast presenting my latest WIP, Sanctioning Lawyer-Criminals, to the faculty at the Georgia State University College of Law. Excellent feedback and engagement—can’t wait to return!

New professional responsibility article, new spreadsheet for writing accountability. Can you tell I was the student in law school that tabbed their outlines and always had multi-colored highlighters on hand?

Listening to a fascinating conversation on AI and ethics, moderated with Ben Edwards (UNLV) and sponsored by the AALS Section on Professional Responsibility. #AALS2025

I just presented several empirical studies on sanctions with the Oklahoma Bar Assoc., including the (under)sanctioning of lawyer-criminals. Lots of wide eyes when I talk about private sanctions (they exist!) and that felons routinely are not disbarred. Always happy to do a faculty workshop or CLE!

I got to nerd out at #lexcon24 and talk about using performance level descriptors on the NextGen bar exam. Thanks to AccessLex for putting on such a great conference—and now back to Norman!

My latest WIP, “Sanctioning Lawyer Criminals,” was recently accepted for publication by the W&L Law Review! In it, I document the lenient discipline that has been imposed in many states and map out possible reforms. It will be on SSRN soon, but in the meantime email me—feedback welcome!

Happy National Coming Out Day! For me, it was 1997. I wish I could say it went smoothly, but it didn’t. I lost my family, was homeless, and couldn’t see a path to stability. But here I am with my husband, a @UofOklahomaLaw professor and @BatesCollege president. It gets better.

Learning so much about humantarian immigration programs from my spectacular @UofOklahomaLaw colleague @kit_johnson!
November 18, 2024 at 11:32 PM

On the way to #SEALS2024. May the airport odds be ever in my favor!

I'm looking forward to presenting my next project, tentatively titled "Sanctioning Lawyer-Criminals," this fall. It will be on SSRN later this summer, but I'm happy to send it to legal ethics enthusiasts in the meantime.

Not surprisingly, I was that person in law school that color coded and laminated his outlines. Getting ready to start my summer writing project, so I started a new article writing tracker (with color-coded formatting to track my daily and overall progress). Let’s go!
