Indeed. It also assumes that the two are mutually exclusive, which is sometimes true, but is an important assumption to check. I can point at a dozen or more good ones publishing work openly.

If only there were scientific methods we could apply to investigate the impact of these tools, for particular populations, in particular contexts, to avoid the need for lawsuits, select and reward the good ones. 😀
