The prohibition on inquiry into motives was specifically with respect to criminal charges. One would hope, maybe in vain, that they wouldn’t extend it to all civil contexts.

What is the issue with this? If drug companies bear the liability, they’ll raise the prices to offset, which gets passed off to payors and ultimately to the public. If gov pays, it’s also ultimately passed to the public. Seems like it ends up in the same place, but removes an anti-vax talking point.

It is taking such an extraordinary amount of litigation to get this one guy some modicum of due process. But hundreds are already in CECOT and South Sudan, and over a million are losing TPS. There’s only so much the immigration bar can do in the face of such lawlessness from the administration.

Can you talk about the process for criminal contempt? Sounds like Judge Boasberg made a probable cause finding, but then there also needs to be a show cause hearing, referral for prosecution, and then ultimately some sort of sanctions if there’s a finding of contempt that’s not purged?
