If you consider physical sex to be irrelevant compared to gender, then i understand you won't agree with that viewpoint.
I think a person's physical sex is irrelevant in most social interactions - but not always.

EA2010 allows for single-sex spaces where appropriate.
Dr Upton may live her life as whatever gender she chooses, and it shouldn't impact her work environment.
If her sex is male, and she doesn't seem to be claiming otherwise, then she shouldn't be in a female changing room.

Or that Dr Upton chose not to use, of course.
