Is it possible that the dispute is in confidential arbitration (which would allow for subpoenas to be issued), and that this complaint procedure is the way Ms. Lively could get around her confidentiality obligations and go public?

I liked your article! But consider California's prohibition on insider trading (Corp. Code § 25402) since many private companies on secondary markets are here. The answer to "is insider trading of private companies illegal in California?" isn't "mostly, no." It's "definitely no." I wrote more here:
