In 2005, President George W. Bush (43) asked the U.S. Department of Justice about the legality of using autopen. The DOJ determined it was Constitutional.

Harry S. Truman may have been the first U.S. president to use an autopen. Lyndon B. Johnson was the first to use it openly, and Barack Obama used it in 2011 to extend the Patriot Act. It's a Constitutional problem to declare now, "nope, not legal."
