We discussed that in class. I don't think they are precedential but the Court treated Wilcox that way in Boyle, so it seems unlikely to me that any lower court would hold otherwise until Slaughter comes out. Making law that way is problematic, as Vladeck and others have observed. But here we are.

I'm a little surprised that he thinks Walmart, Apple, Capital One, Goldman Sachs, Experian etc etc etc are small businesses. (Snapshot from 2024 enforcement report) :)

So nice of you, thanks! I was teaching a class so I’ll have to go back and watch the stream myself. As a newbie, I am thrilled to learn from skilled folks solving my puzzles and giving so much useful on the spot guidance.
