Any recovered assets are split between the enforcer and the court system in the U.K. but the quality and number of financial investigators available is a problem. There simply aren’t enough!!

The clue is in the title “proceeds of crime act”. Once there’s a conviction an application is made and the court will make a determination as to who pays what. A good financial investigator will identify all assets suspected of being funded by crime. It’s then up to the defendant to prove otherwise

Fraud is a criminal matter, you don’t “sue”, you prosecute. A POCA order can then be sought against the directors.

POCA is used AFTER a conviction. I believe it would be an unexplained wealth order we would have to see being sought. I seem to recall the Scottish government considered this but either didn’t follow it up or were refused one
