Court is adjourned!
November 12, 2025 at 9:03 PM
Still going.
This case has been assigned to District Judge April Perry for trial (yes, same judge whose restraining order bars Trump from deploying the National Guard in Chicago).
A status hearing is set before Perry for Dec. 4

Judge McShain says Abughazaleh does NOT have to report incidental contact with law enforcement in the performance of her employment or duties
November 12, 2025 at 8:57 PM
Abughazaleh's status as a Congressional candidate comes up for the first time, as her lawyer asks to modify the standard condition of bond that she report every contact with law enforcement to pretrial services
November 12, 2025 at 8:52 PM
Judge McShain decides Straw does not have to turn in his passport, prompting Mecklenberg to say well then none of the defendants should have to, either.
So the great passport debate is over. They all get to keep them- even though they can't travel
Now on another break.
Longest. Arraignment. Ever.
November 12, 2025 at 8:38 PM
Prosecutor Sheri Mecklenberg says this is about bond conditions, not about what ICE is doing on the streets, and that defendants have turned in their passports "in every case I've had for 19 years."
November 12, 2025 at 8:37 PM
Parente questions the reason for Straw "to sit here now and ask him to turn his passport over to the government for no reason other than they think they can?" He says landscapers arrested by ICE "cannot stand up to the government. Mr. Straw can, and your honor can too."
November 12, 2025 at 8:36 PM
Chris Parente, lawyer for Brian Straw, objects to forcing him to surrender his passport, saying he's a "boring suburban dad" and that his reason for going to the protest in the first place included objecting to the government checking people's passports and papers
November 12, 2025 at 8:35 PM
Among the bond conditions Abughazaleh agrees to is to not travel outside the continental U.S. without prior approval of the court.
November 12, 2025 at 8:20 PM
Judge McShain is on the bench
Abughazaleh pleads not guilty though her attorney, as do all the other 5 defendants.
Prosecutor Sheri Mecklenberg says they face up to 6 years in prison on the conspiracy charge.
November 12, 2025 at 8:10 PM
We've been in a holding pattern while the judge reviews the bond petitions behind closed doors. Now all of the defendants' attorneys have been called back to her chambers.
This is officially the longest arraignment I've ever covered and it hasn't even started yet

Cummings says based on this analysis it's "highly unlikely" that any of them are criminals, gang bangers, or "assorted other ne'er-do-wells who fall under the category that ICE has described as the 'worst of the worst.'"
November 12, 2025 at 5:53 PM
Cummings describes a sampling of Midway Blitz arrests:
54 were arrested while at work.
20 landscapers, 4 Uber or taxi drivers
2 street vendors
20 were commuting to or from work
9 arrested at Home Depot or Menards
11 in public places, including a Dunkin Donuts drive thru
November 12, 2025 at 5:50 PM
Cummings says it's clear there have been "repeated material violations" of the consent decree under "Midway Blitz," and that under his reading of the law, the only arrestees subject to mandatory detention have prior removal orders or criminal histories.
The rest deserve a bond.
November 12, 2025 at 5:44 PM
They've moved onto the issue of how many of the arrestees are subject to mandatory detention due to their previous criminal history.
The plaintiffs say the vast majority have nothing on their record.
