It’s great to see the court where I was a judge’s law clerk get some recognition — and for something that’s not IP law, like much of the Fed Cir docket.
The Federal Circuit has imposed an administrative stay of the decision blocking the tariffs while it figures out whether to grant a stay.

Those who knows the Court, why is it acting en banc?

An interesting decision for those of us who’ve litigated preliminary injunctions. And for we who watch the interaction of state and federal courts.

SCOMO chose to follow USCA 8th circuit in changing a legal standard. It didn’t have to, but chose to.

I used to tell my Mizzou Law appellate practice students that oral argument is my favorite thing to do in my profession — but also what a tiny portion of my work the actual argument is.
That’s it. Oral argument is the appellate lawyer’s treat for all the other work we do.
Had oral argument yesterday.

It is such a fun hour.

The weeks/days/hours of prep beforehand . . . are less fun.

But the payoff is just such a rush.

What a cool job we have.

It took a few years, but we now have finality in our victory confirming the Mo Hwy & Transp Commn’s constitutional authority to use the state road fund w/out legislative interference.
