This week, on 10 December, the Int’l Human Rights Day, in commemoration of the adoption of the Universal Declaration of Human Rights 76 years ago, we had an open day. The independent Fundamental Rights Office monitors, advices on and builds capacity in European border management.

Note that the prior CJEU judgment concludes that a ban on a category of people applying for asylum breaches not only *EU legislation* but also the *EU Charter of Fundamental Rights* - ie the primary law of the EU. So an EU Council emergency law purporting to let Poland adopt a ban would be invalid.

At first sight, an obvious breach of EU law - unless this simply amounts to a delay in processing asylum applications, or the idea is to request the EU Council to adopt an emergency asylum law allowing Poland to do this. The asylum pact 'crisis' law does not apply yet, and does not provide for this

In short order, Hungary has challenged military support for Ukraine and the European Media Freedom Act, while the Le Pen party has challenged the new EU asylum pact. Populist RW parties/govts increasingly becoming plaintiffs in the EU courts, not only defendants.
Hungary sues EU Council and European Peace Facility - no further details, but presumably this is a challenge to the circumvention of the Hungarian veto on military aid to Ukraine?
