from LinkedIn Royal Johnson, PhD Associate Professor and Director In light of the Trump administration's recent Executive Order (J21 EO) targeting Diversity, Equity, and Inclusion (DEI) efforts, a group of leading legal scholars has released a critical memo outlining why DEl programs remain lawful under federal civil rights laws and Supreme Court precedent. Here are a few key takeaways for higher ed leaders: * DEl is still legally defensible-federal civil rights laws support initiatives that promote equity and combat discrimination. * Universities' First Amendment rights remain intact- institutions can still express commitment to diversity, equity, and inclusion in their mission and communications. * SFFA v. Harvard does not prohibit DEI-while the ruling restricted race-conscious admissions, it does not broadly ban DEl efforts in hiring, programming, or institutional commitments. * The J21 EO is being legally challenged-a federal judge has already issued a preliminary injunction on key parts of the order. * Institutions should NOT preemptively roll back DEI programs-this memo makes clear that many common DEl efforts remain both lawful and essential for fostering inclusive learning environments.
