The healthcare law that gives healthcare to illegal immigrants is the Emergency Medical Treatment and Labor Act (EMTALA), passed in 1986 during President Ronald Reagan’s administration. It requires hospitals that participate in Medicare (which is the vast majority of U.S. hospitals) to provide emergency medical screening and stabilizing treatment to anyone who comes to the emergency department, regardless of their ability to pay, immigration status, or insurance coverage. Hospitals cannot “dump” patients (refuse treatment or transfer them) because they are uninsured or unable to pay. The law was originally included in the Consolidated Omnibus Budget Reconciliation Act (COBRA) of 1985, and Reagan signed it into law in 1986. THE DEMOCRATS ARE NOT TRYING TO GIVE HEALTHCARE TO ILLEGAL IMMIGRANTS.. The explosion in ER spending since the 1990s–2000s is far more about baby boomers aging into high-cost care than about undocumented immigrants. Immigration is often used as a talking point, but the data shows the true pressure comes from demographics and chronic disease prevalence in the U.S.

The Constitution Is the Highest Authority — Not the Voter Mandate. Even if a politician wins by promising to do something that would violate the Constitution, that “mandate” has no legal force. The U.S. Constitution is the supreme law of the land (Article VI, the Supremacy Clause). Every elected official, from president to local sheriff, takes an oath to uphold the Constitution, not to carry out every campaign promise. Therefore, no election result can authorize unconstitutional action — not even by majority vote
