Weird malpractice pattern this summer: missed tumors on cancer screens.

Three obvious ones in 6 weeks.

If you’re a clinician, attorney, or reviewer: don’t just trust the report. View the actual images.

Get a DICOM viewer. It takes 5 mins.

It can change everything.

Tried a bunch of AI tools for med mal case review. I want them to work... flat fee means efficiency = $$$. But so far? Nope. Too many errors, not enough nuance. Stakes are high, and the tech isn’t there yet. AI helps me make mistakes faster… tequila is a close second.

Just because you can make a case doesn’t mean you should.

If causation needs a 10-step flowchart to explain, it’s probably too complex to win.

Simple = strong. Complicated = risky.

Even seasoned attorneys know when to walk away.

Don’t just read the radiology report—look at the images. Subtle but critical findings can be missed. This applies to treating providers and expert reviewers alike. It only takes a few minutes and can make all the difference.

A gully washer, as they say in southwest Missouri.

After the heavy rains, nature clears out the clutter.

A reminder: let the debris wash away, make room for new growth, and take a moment for self-care.

Nature resets. So can we.

Shortening depositions is one reason I built Expert Retainer. No endless questions about how the expert got connected to the case—just one line: “We were connected through Expert Retainer.” Free to experts. No ads. No middlemen. That’s how expert witness matching should work!

Almost missed it, but then it jumped off the screen: a prescription for an OTC med that interacted with another drug the patient was on. Deadly mistake. It’s a reminder: know your interactions and don’t click through EHR pop-ups.

Does every medical malpractice case need the “best expert”? Not necessarily. Sometimes a top-credentialed expert matters, but often you just need someone who’s qualified, relatable, available, and experienced in the “real world.” The “best” expert isn’t always the flashiest CV.

Shared decision-making isn’t just a checkbox... it’s real. Boilerplate templates don’t save you when outcomes go wrong. Document specifics... what was discussed... why the patient chose a different path... questions and answers. Skip the fluff, capture the real talk.

“Tag, you're it!” isn’t enough when the stakes are high.

A referral for a possible malignancy? The loop must be closed. Too often, patients get lost between emails, orders, and missed calls.

Shared responsibility demands shared accountability.

And yes... we still use faxes for HIPAA compliance.

A med mal case is like bourbon—it needs time to mature.

Jump in too early and evolving damages can wreck your strategy.

Like bourbon aging in oak, the right timing reveals the full story.

Not too soon, not too late.

Physicians, PAs, NPs…

When a nurse says they’re worried…
You should be worried.

I’ve reviewed too many cases where nurses flagged a change… documented it… and the provider didn’t follow up. The outcomes?

Bad.

Listen. Acknowledge. Examine.
Close the loop.
Save a life. Prevent a lawsuit.
