A pardonee must admit the crime. If prosecuted, she/he presents the grant as a defense. The prosecutors argue against the pardon’s validity. A valid pardon depends on the pardon being beneficial to our society and has nothing to do with its effect upon the pardonee.

The discussion from the day was not simply that it was cold, but the fact that John Kennedy didn’t wear a hat, even though it was cold.

And then I became a trend not wearing hats, even in winter.

It’s unsurprising, considering our pardon power’s legal formation is expansive in its history and encased in difficult-to-collect research sources. Only to be further complicated, by questionable Supreme Court decision-making as to earlier pardons and amnesties from our Civil War era.

Within the week, we the people, will become perplexed by an amnesty to be given to the Jan. 6, 2021, perpetrators at the U.S. Capitol. In discussing the presidential act most pundits will state the law of pardons incorrectly and discombobulate the discussion of the purported act of clemency.
