Well Yeah. If it were a "War" on citizens then only Congress can give that order. POTUS has some power under circumstances other than War on citizens. The hard part would be getting SCOTUS to label it a "War on Citizens".

That fight was a lost cause. It would have worked if SCOTUS had protected the SNAP benefits. But such is life.
