The rule says they have an automatic extension of status based on timely filing. This is the same system as work visas and other nonimmigrant visa types.

Even if the constitutional aspect wasn’t facially, exactly wrong, that wouldn’t resolve the APA issues with granting derivative right? No legal procedure exists for “admitting” newborn derivative nonimmigrants except for A visas. The courts blocked Biden’s parole-in-place proposal on this basis.

Did the person know writing this know that dependent visa statuses (eg F-2, J-2, H-4) are different than principal visa status? Clearly no one bothered to ask the question of how to not make hundreds of thousands of people stateless before they decided to rewrite the constitution by executive order
