The checks n balances are supposed to be kept by the 3 separate but co-equal branches of government. Executive, Legislative & Judicial.

And be it called a "shadow cabinet" or not, such specialists exist within the opposition party in majority of US government's.
Raskin/Goldman etc etc are constitutional lawyers/scholars and as such will be a focus for and such matters etc, etc, etc.

In UK, we have "shadow ministers" in our Government, & have done for a long time. [We don't, technically, have a two party system though.] It's just a way of designating someone from the opposition party that heads up counter policies & holds the duly elected minister to task regarding performance
