I'm not any kind of ECJ expert (this is a fandom account lmao) but my reading is that the court's reasoning could go either way re noncitizens and could possibly lay the groundwork for a right to marriage equality down the road

the court notes that failing to recognize marriages between citizens performed in another member state "infringes not only the freedom to move and reside, but also the fundamental right to respect for private and family life"

it's also not clear to me whether it applies to marriages between *noncitizens* who were lawfully married in an EU member state, particularly as the court's reasoning is grounded in part on the right of EU citizens to move and reside within member states
