You seem like a reasonable fellow though, so here is a link that dives deeper into the point I’m trying to make. That HIPAA can be avoided by some actors, despite what the average person had come to expect of HIPAA.

It’s about whether the institution at any point deals with making claims to insurance or they process those records (ie clearinghouses and yes EMR repositories). Not about how you interact with them. Apple does not make insurance claims as their business so no HIPAA. State privacy laws may apply tho

They are probably billing insurers, so yeah they can be considered a covered entity. But Apple and other apps/devices that you store this health information and data with, are not bound by HIPAA regulations. Just general FTC regulations against unfair/deceptive practices (vague) and state laws.

It should be! However, it’s in the name “Health Insurance Portability and Accountability Act”. Only covered entities are bound by HIPAA. Device manufacturers and developers are not “covered entities”. Hell, even a doctor who only takes cash and makes no claims to insurers or clearinghouses isn’t…
