Though as I recall the rule used to be that settlements came out of agency funds - maybe that has changed.

Agreed. Spent all day in the heart of downtown at a great symposium by the Oregon Historical Society. Nary a war, invasion, or predatory incursion to be seen. Lovely evening.

Is that SG concession effectively rooted in the precedential authority of the Court? If so, does it mean that the first CA9 decision upholding a D.Ct injunction have circuit-level injunctive effect? (Sure, US could do intracircuit non-acquiescence, but the circuits tend to not like that.)
