I guess the larger argument here is if it ought to communicate and if the determination is no then maybe behaving in spite of known rules is the moral course of action.

This is the position I take on many of these situations as an irreverent twat by temperament.

But you do lose stuff by doing so.

See in a similar case of slurs or swearing where clearly there are reasons why one might be using certain language that isn't just hatred.

But if intent is established I do think you could see what they are communicating as immoral, similarly to the example of wedding suits, black at funerals, etc.

If you were to talk to said person and determine some other motive for such behaviour it is clearly incredibly stupid to carry on the assumption of rudeness.

But I think knowing what you are communicating is an aspect of behaving virtuously. As much as it hurts my irreverent ass to say so.

Incredibly based... I will say though there is an element here where if the meaning of the communication is discovered to have intention you could argue a moral case.

In the example of wedding suits, if the person is knowingly flouting expectations, you could argue they are being rude on purpose.
