The court found the Penal Code Section 226 to be in violation of Article 27 of the constitutional which guarantees dignity, equality, and the right to the highest attainable standard of health.

Penal Code Section 226 punished individuals for “attempting suicide” with up to two years in prison, a fine/ both, failing to consider nuanced reality of mental health struggles, deterring people from seeking help and worse, exacerbating the stigma surrounding mental health.

On 9 January 2025, High Court Judge Lawrence Mugambi declared that Section 226 of the Kenyan Penal Code, which makes suicide a criminal offence,Unconstitutional.

According to WHO(2019),Suicidal ideations associated with depression lifetime prevalence is 7.9%.In Kenya, it is estimated Kenya’s age standardized suicide rate to be 11.0 in 100,000 while globally, 700,000 persons are estimated to die by suicide every year.
