Sorry I'm just an idiot doctor so I don't understand this (though I honestly appreciate you trying to educate me!). I guess my question is what is impeding AI companies from seeking permission from the copyright owners they can identify (apart from move fast/break things/beat the other guys)?

Like if I make a cartoon with Bart Simpson in it and don't seek permission, saying "ah it was gonna be a lot of work to do that" is no protection.

But plenty of copyrighted works do have known ownership, and permission can be sought. Saying we didn't try because it was too hard is again a weak defense to me. Not a lawyer.
