Some fairly heavy hinting here from the judge about other remedies I thought
"Ms Berwick has commented in her closing submissions that the observations being made by Mr Verdier are intrusive and she is concerned that Ms Saunders is carrying out surveillance upon her, and others. This may be a well held suspicion. Of course, there are steps that could be taken with respect to such behaviour (if it is being undertaken) but it is not something that I can deal with without an appropriate application"

I'm not sure marketing this as an either/or proposition was entirely sensible.
