وبالمثل، أُدين القاضي الرحماني مؤخرًا، وهو أيضًا أحد القضاة المقالين، وحُكم عليه غيابيًا بالسجن ثلاث سنوات بتهمة إهانة الغير على وسائل التواصل الاجتماعي، في انتهاك لحقه في حرية التعبير، ورغم تمتعه بالحصانة القضائية. (4/3)

تشكل قضية القاضي المسعودي، الذي أُقيل مع 56 قاضيًا آخر في عام 2022، مثالًا على لجوء السلطات التونسية إلى الملاحقات التعسفية ضد القضاة، مما يقوض استقلال القضاء. فعلى الرغم من تمتعه بالحصانة القضائية، جرى توقيفه واحتجازه في عزلة. (4/2)

The ICJ urges the Tunisian authorities to immediately release Judge Messaoudi, quash the conviction and sentence of judges Messaoudi and Rahmani, end attacks on judges and prosecutors, reinstate an independent High Judicial Council and respect judicial immunity. ⚖️ (4/4)

In a similar vein, Judge Rahmani, also one of the dismissed judges, has recently been convicted & sentenced in absentia to three years’ imprisonment for insulting others on social media, in violation of his right to freedom of expression, and despite his judicial immunity. (3/4)

The case of Judge Messaoudi, who was dismissed along with 56 judges in 2022, exemplifies the Tunisian authorities’ resort to arbitrary prosecutions against judges, undermining judicial independence. Despite his judicial immunity, he was detained and held incommunicado. (2/4)

All States must act to prevent this plan and press for a lasting #ceasefire that protects civilians and ensures the release of #hostages. (2/2)
