Harris can certainly afford private security if she feels she needs it. I would prefer that police secure people who aren't wealthy enough to afford guards on their own.

Every time he is forced to abuse his power he risks losing more and more legitimacy. He should be backed into a corner and forced to act as self servingly as possible, or made to comply. By no means should he be given implicit permission by being allowed to act freely.

OBJECTIONS AND RESPONSES TO EXPEDITED INTERROGATORIES Interrogatory No. 1: Describe with particularity each action You have already taken, and when, to Facilitate Abrego Garcia's release from custody in El Salvador. 2 Case 8:25-cv-00951-PX Document 98-1 Filed 04/22/25 Page 4 of 19 Defendants Response to Interrogatory No. 1: Defendants object to Interrogatory No. 1 as based on the false premise that the United States can or has been ordered to facilitate Abrego Garcia's release from custody in El Salvador. See Abrego Garcia, 604 U.S., slip op. at 2 (holding Defendants should "take all available steps to facilitate the return of Abrego Garcia to the United State") (emphasis added). Defendants further object to Interrogatory No. 1 as calling for information that is protected by the attorney-client privilege, the deliberative process privilege, the state secrets privilege, and the governmental privilege. Defendants incorporate their objections to definitions and objections to instructions. Subject to and without waiving the forgoing objections, Defendants respond as follows: Before the Fourth Circuit's decision of April 17 clarifying its understanding of "facilitate," the United States took the position that the only steps needed to facilitate the return of Mr. Abrego Garcia involved removing domestic barriers. After the Fourth Circuit's clarification, the State Department has engaged in appropriate diplomatic discussions with El Salvador regarding Abrego Garcia. However, disclosing the details of any diplomatic discussions regarding Mr. Abrego Garcia at this time could negatively impact any outcome. 2 NOEM v. ABREGO GARCIA Statement of SOTOMAYOR, J. and subsequently referred the application to the Court. The application is granted in part and denied in part, subject to the direction of this order. Due to the administrative stay issued by THE CHIEF JUSTICE, the deadline imposed by the District Court has now passed. To that extent, the Government's emergency application is effectively granted in part and the deadline in the challenged order is no longer effective. The rest of the District Court's er remains in effect but requires clarification on remand. The order properly requires the Government to "facilitate" Abrego Garcia's release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador The intended scope of the term "effectuate" in the Distri Court's order is, however, unclear, and may exceed the District Court's authority. The District Court should clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs. For its part, the Government should be prepared to share what it can concerning the steps it has taken and the prospect of further steps. The order heretofore entered by THE CHIEF JUSTICE is vacated. Statement of JUSTICE SOTOMAYOR, with whom JUSTICE KAGAN and JUSTICE JACKSON join, respecting the Court's disposition of the application. The United States Government arrested Kilmar Armando Abrego Garcia in Maryland and flew him to a "ter-rorism confinement center" in El Salvador, where he has been detained for 26 days and counting. To this day, the Government has cited no basis in law for Abrego Garcia's warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison. Nor could it. If the government’s position is that being trafficked to El Salvador by Donald Trump and Stephen Miller amounts to a final and irreversible deprivation of all rights, then it seems to me every federal court has a duty to permanently enjoin the practice as soon as it possibly can.
