Emulation itself (in America, can't speak to anywhere else) is legal, as long as you are using your own ripped cart. The software behind emulation is legal as long as it isn't pointing to illegally accessed files. Like torrenting, both legal, just heavily used nefariously.

Worst of all I likely purchased them a couple of times via an eShop that doesn't exist anymore. Physical isn't a black/white answer either, as day 1 patches are gone (speaking legitimately) and publishers started saving money on cart capacity, holding portions of the game behind that day 1 download.
