The museum is not reluctant to return the fossil. The state government considers the specimen state property and does not allow it to be returned.

Yes, it is. The ICZN does not consider names of fantasy creatures at all relevant. You could legitimately name a new genus of tardigrade Godzilla. I just recently dealt with this issue.
