The argument to the court will be that the phrase that’s quoted only applies when the Senate selects the vice president in the case the electoral college does not select by majority. Again, read it. It’s not in enumerated clause and that’s the loophole.

Again, reread it. Your interpretation (and the popular interpretation) do not match the letter of the law and the letter of the law is the law, when the despots who interpret the law have the mandate to do so.

Alito and Thomas obviously want to burn the place down, but yes, that’s just 2. Gorsuch votes with them *nearly* every time. Kavanaugh is another shoe-in. ACB is the wild card as I’m concerned, and she’s voted 70% with the other conservatives on the bench. Roberts doesn’t matter

The gotcha is that prior to XII, the VP was runner up. The “but” would have to be at the beginning of the language, prior to the part lack of majority vote. Better, its own enumerated section to be bullet proof. Because it’s not, it’s open to Judicial interpretation.

Again, words matter, as does order. The language says the person having the most votes for VP gets the job. The “but” only applies to whom the Senate may choose to serve if the Appointed Electors dont have a majority for VP as then Senate isn’t restricted to primaries or general election candidates

While that is the popular understanding of the role, reread the Article II and associated Amendments, it’s not the *letter* of the law. As we know, in law, words matter, and Alito & Thomas are sticklers for the word when it suits their aim.

It says *nothing* about being elected VP. And no rule forbidding succession if the elected POTUS resigns.

Congress cannot, it requires 38 state legislatures to change the Constitution

But everyone seems to be missing the point: the Constitution is silent on a former 2 term POTUS being VP on a ticket. And the explicit Alito/Thomas loving language says *nothing* about that VP if the elected Pres resigns

My point is, he may never change. And some might look around today and think the world won’t change. I believe I’ve seen otherwise, even though it’s long, often painful, with starts and fits, and always deeply personal. I’m sorry his choice hurts you. It won’t last forever. One way or another 😞

Growing up, we were in the white flight suburbs of Detroit. My elementary school had over 1000 students, K-6th, and maybe 5 non-white passing minority kids. My kids go to that same school, 30y later, about the same number of kids, I couldn’t say if there’s a racial majority or even a plurality.

1)…what is *not* in it. The Constitution lists only three rules for becoming VICE President, there are no limits to number of terms a VP can serve, and the succession clause TECHNICALLY does not say anything about disqualifying a VP from becoming President even if they have already served 2 terms😣

❤️ I started doing that about 8 years ago: my oldest was allergic to Avocado, my youngest to sesame, and my wife is sensitive to MSG (makes her migraines worse), so I’d treat myself to a veggie sushi roll every grocery run (until I found out I was diabetic and needed to watch my carbs)
