There are at least two examples of this in US history: the end run around the AoC, which was both illegal and extra constitutional, legitimized by ratifying conventions ex post, and the civil war which was basically war time exception to usual legal order.

This whole hysteria on the right about under representation of cons in academia drives me crazy. It is endogenous and self selecting. Free inquiry into the liberal arts is inherently left coded. Material rewards are lacking. Why go into academic STEM when you could make more money in industry, etc?
