But there would still be the qualified immunity unless Congress explicitly eliminated it as well, right?

Yes, but previously it was worded as "consideration of the application ... is deferred" (not "the application ... is deferred").

How do you know the docket number in advance?

How long do you think SCOTUS will take to decide the Trump tariffs case, given the fast-track schedule? Is it possible or likely that they will hand down the decision as early as November or December?
September 10, 2025 at 1:03 AM
Thank you. Already docketed as No. 25-250: www.supremecourt.gov/Search.aspx?...

So the Solicitor General has already filed the certiorari petition? Is it already published?
September 4, 2025 at 1:18 PM
Correct me if I'm wrong, but isn't a protective notice of appeal usually filed on the last day of the appeal deadline to buy more time to decide whether to pursue an appeal or not?

If the en banc Fifth Circuit rules for Texas and against the federal government, it would be interesting to see whether the Trump administration will seek review from SCOTUS.

But the website which the courts ordered to be restored is still not functioning: apportionment-public.max.gov

Is the injunction already in effect? As it was stayed only for 7 days, which apparently expired on July 17, 2025, 11:59 PM.

The foreign affairs argument is quite problematic, but I don't see a problem with the DOJ simply exercising discretion not to prosecute/enforce this law. There are plenty of other federal laws which are not enforced and it's a good thing that they aren't (eg. federal marijuana ban).

Because it was obvious from the oral arguments that the conservative majority will uphold the law, no matter how it conflicts with previous case law. www.scotusblog.com/2025/01/supr...

However, the birthright citizenship case (Trump v. CASA, Inc.) is not actually about the birthright citizenship, but rather about universal injunctions.
June 26, 2025 at 5:45 PM
Free Speech Coalition v. Paxton will likely be decided in favor of Texas.

They got the definition of "leecher" wrong
June 24, 2025 at 2:16 AM
However, this is not about Article III standing, right? What is this "type" of standing called?
June 19, 2025 at 2:28 AM
Maybe plaintiffs will request en banc rehearing?
June 17, 2025 at 8:52 PM
Is it possible to request en banc review of an administrative stay?
June 13, 2025 at 3:39 AM
Is the order appealable?

Is it possible to request en banc review of an administrative stay?
June 11, 2025 at 2:05 AM
Well, the order doesn't specifically say that the administrative stay expires on June 9, just this: "until further
notice while this court considers the motions papers". And the court may take longer to consider the stay motion.

It can be appealed to the Federal Circuit and then to SCOTUS.
May 29, 2025 at 5:38 PM
Yes, to the Federal Circuit and then to SCOTUS.
