Yea I've thought that for ages, seems odd to allow that, but unfortunately legal precedent is on the league's side, as there have been a couple of people who tried. Iirc a referee tried to take a player to court, and it got thrown out because of that clause, think there was another case but not sure

The answer is yes. Part of the collective bargaining agreement dictates that all disputes (including what would normally be legal/civil matters) must get handled within the league.

That aside I'm sure there are clauses in all contracts that consist of waivers against other players.

The panel doesn't get to decide that, they just provide commentary. They were just asking if there should be/discussing if there should be. I'd like to see it but not holding my breath with the NHL.
