Except our legal standard for criminal judicial proceedings is not "probably". It is "proof beyond a reasonable doubt". Any public servant that violates their oath to uphold the US Constitution - as the orange felon has - must be removed from office & prosecuted.

One idea is for a given lawmaker to announce an oversight visit for every day, at every ice concentration camp. AFAIK, nothing ice's regulation (which conflicts with federal law) requires that visit to take place.
