I understand that Congress still gets paid during a shutdown. So especially if that’s true, Johnson needs to do his job and swear her in. Of course he should already of done that.

In a 2-1 decision, Biden appointees Bradley Garcia Michelle Childs ruled that Cook was likely to prevail on the underlying appeal. They were especially focused on the lack of due process given to Cook. Trump appointee Gregory Katsas dissented.
