Oh also forgot to mention. The car can tell if the key is in the car or near the car. I am positive it can do this reliably because it won't let me lock my key in the car but if the key is right outside the door it will let me lock the car. So you can't drive without the key like you suggested

There is a mechanical override key in the key almost always that you can use if the car is dead and you need to get in to pop the hood or whatever

Modern wireless keys use a system similar to rolling codes so they can't be cloned like that anymore. Additionally, when they are dead they can still unlock and start the car via near field
