There were a bunch of op-eds at the time of you search but basically the Constitution gives the Senate binding advice and consent but the President was not obligated to wait forever if they chose not to do that at all.

There were a number of legal folks of the opinion that Obama could have just made the appointment when the Senate declined to even provide a hearing and abdicated their right to advice and consent

Driving by to say that while I agree with your point in this week's ep about liberals opposed to referring to people as felons not affording Trump the same courtesy, I was disappointed you didn't call out the corollary of conservatives who regularly brand folks as felons not doing the same to Trump.

This has been my assumption - people with actual nefarious intentions steering the predictable reactions the way they want. It's the same reason I never doubted the "no collusion" outcome of the Russia investigation - you don't have to collude with dumb guys, you just wind them up and watch them go.

Yeah, these dudes feel off for sure. Could just be last minute staffing, but I there has been plenty of fake "border patrol" for at least a decade so I don't have much confidence there aren't LE cosplayers trying to take advantage of the chaos.

I think you're inverting what I said - IME projects most often fail to go from closed development to open for the reason you stated, the code is too ugly for them to want to put it into public view, ESPECIALLY if they've been monetizing it.
