Nope.
1. It can be, & very often is, challenged by both parent & settings.
2. Code is not law - apart from 0.7% of it. So any poorly, unlawfully written provisions - & I grant you there are MANY - are in conflict with 1 mandatory section and at least 3 case law rulings from Tribunal to the C of A.

I totally understand the feeling but if it were always like that, we wouldn’t be achieving assessments, issue of Plans, legally sufficient funding and improvements in timeline and process.
It is all about how we challenge LAs and whom within them.
