I don’t believe that is correct under 15USC6581(b)(1)(A). You have a case if someone discloses your intimate images without your consent, full stop.
It’s civil court, not criminal, so you don’t need proof beyond a reasonable doubt, it’s a preponderance of the evidence standard.
