If not truth, then what? That’s my underlying worry. I’m one who thinks the system needs to recommit to the search for truth as its central justificatory axis.

My rx came from the fact that I worry our crim justice system often underplays the importance of the truth. That’s meant to be a worry that is agnostic about defence/prosecution perspectives. Eg both plea bargaining/unreviewable prosecutorial discretion & legal rights often stand in the way of truth

I get the angle now. From that direction, it’s a pro defence claim. I read it the other way around… as long as it can be proved, it doesn’t matter if it’s true all things considered!
