i agree, they are the ones actually implementing the rules. it's just that itch essentially is forced to comply since if all the payment providers stop allowing itch to use their services, itch and the creators essentially cannot earn money. itch has essentially no control over the situation.

The thing is, itch are not the ones complying with fascists. They have to comply with corporations who did comply with fascists. Payment platforms had no obligation to add these rules in their terms. Itch does. The fascists themselves have little power, but the complying companies do.
