RRO Appeals: how long do they take? 5 months minimum

We wanted to advise our clients on how long they could expect an appeal of a First-tier Tribunal decision might take at the Upper Tribunal. Here is a table of appeals from 2024 showing the delays. Quite a range: 150 to 431 days

Here are some more findings from our survey of independent or DIY Rent Repayment Order (#RRO) Applicants.
NB: Local Authorities gave unclear answers to Applicants request for information in 35% of cases. In ~10% of cases they gave information that directly led to the loss of the RRO case.

A recent #RentRepaymentOrder (#RRO) decision from the Upper Tribunal found that a superior landlord was actually the direct landlord but then wasn't. And it didn't matter anyway. Our latest blog:

When @Unite_Student tried to license their Queens Park House property in Coventry, the LA found that their Electrical Safety Certificate was "unsatisfactory"

Unite had to undertake remedial works to ensure the 464 students in the block were safe.

Sort of 100%...but the Tribunal does not allow any rent to be repaid from a period which overlapped the start of the licensing scheme on 1st March, quoting Kowalek...not sure that really applies here! Rent was paid 14th Feb to 14th March but none of this was allowed in the RRO

Judge Nicol continues to argue against the deduction of utilities from RROs, as guided by UT. Quite right too. Rent is defined in HaPA (s52) as rent that can be claimed for UC. DWP guidance for UC rent do not separate out utilities so nor should the juiciary

Ball dropped completely here. Had the Applicants pleaded an alternative offence of breaching Southwark's Additional Licensing scheme then they would have won! Slight hint in Tribunal decision!

UT's idea that criminal sentencing helps to rate the seriousness of offences listed for RROs just doesn't work, as shown by our analysis here, where 4 of the more common offences end up with the same rank:

With Judge Nicol, a consensus is growing: much UT guidance is confusing at best or just plain wrong.
HaPA 2016 was meant to toughen the licensing regime of 2004 Act, not weaken it.

they have to fight to get a case to the code "Tribunal".
An example: a student's complaint that their building's fire detection system was not working before moving in was upheld

We have heard many complaints from students in such blocks where conditions were near to intolerable: excessive heat, infestations, repairs not done. Many have also suffered on-going building works outside their windows due to re-cladding etc.

The code was set up in 2004 following safety concerns for such blocks. Members must obey strict guidelines, all specified here:But...the scheme is largely self-administered and there is little oversight.

In January a student block in Leeds was closed by @WYFRS :
