Yeah I completely get that and i can imagine it's tough to get the balance right as nuances in the law also have difficulties and can lead to uncertainty and more litigation.

I think if it took on that kind of role it risks becoming more of a political and activist body, like in the US.

Its job is in interpreting the law and Parliament has responsibility to change or clarify things based on those rulings if needed
