No, a "biological construct" means it exists in our heads, not as an external object. Even the markers used are somewhat arbitrary. Do a literature search.

In your article, you insist on an antiquated vague definition of "sex binary" while admitting it doesn't work for at least 1.4 M people worldwide.
The more accurate picture today is a continuous multidimensional bimodal distribution. It's not a binary, and it implies no one is exactly at the modes.
